Cancellation policy
1. Information about us
1.1 We are Giggle Kitchen Ltd ("Giggle Kitchen", "we", "us", "our"), a company registered in England and Wales under company number 17026974, with our registered office at 21 Granville St, Deal, Kent, CT14 7EZ. We operate the website gigglekitchen.co.uk (the "Website").
1.2 To contact us, email dan@gigglekitchen.co.uk.
2. These terms
2.1 These terms and conditions, together with our Privacy Policy and any other documents referred to in them, set out the terms on which we supply our recipe kits and related products ("Products") via our Website, whether as a rolling monthly subscription (the "Subscription") or as a one-off purchase.
2.2 Please read these terms carefully before ordering. By placing an order, you agree to be legally bound by them. If you do not accept these terms, you will not be able to order Products from our Website.
2.3 We may amend these terms from time to time (see section 15). The terms in force at the time you place an order are the terms that apply to that order.
3. Who can order
3.1 By placing an order you confirm that: (a) you are at least 18 years old; (b) you are legally capable of entering into binding contracts; and (c) you are resident in, and ordering for delivery within, our delivery area (see section 8).
3.2 Our Products are designed for children to cook with adult supervision, but all orders must be placed by an adult, and the contract for the purchase of Products is between Giggle Kitchen and that adult.
3.3 Your account: you are responsible for keeping your account login details confidential and for all activity that takes place under your account. If you know or suspect that someone else has access to your account, tell us at dan@gigglekitchen.co.uk and update your password promptly.
4. Our Subscription service
4.1 The Subscription is a rolling monthly plan. Each month, a new themed recipe box is delivered to you on your nominated delivery day (Thursday or Friday), and your chosen payment method is charged on a recurring basis until you cancel.
4.2 You may pause, skip or cancel your Subscription at any time via your account page on the Website, at no charge. If you have any difficulty doing so, contact us at dan@gigglekitchen.co.uk.
4.3 Cut-off: changes to your Subscription (including pausing, skipping or cancelling) must be made before the order cut-off for your next delivery, which is 12:00 noon on Monday for Thursday delivery, and 12:00 noon on Tuesday for Friday delivery (the "Cut-Off"). Changes made after the Cut-Off will take effect from the following month's delivery, and the next delivery will still be processed and charged.
4.4 Monthly box contents (recipes, theme, ingredients and included extras) change each month and are described on the Website. By subscribing, you accept that the contents of each monthly box will vary.
4.5 We reserve the right to decline or not renew any Subscription at our discretion, including where we reasonably suspect fraud or misuse of promotional offers.
5. Ordering and contract formation
5.1 Your order constitutes an offer to purchase Products. After placing an order you will receive an email acknowledging receipt. A contract between you and us is formed only when payment is taken and we send you confirmation that your order has been accepted.
5.2 We are not obliged to accept any order and may decline orders at our discretion, including where we cannot deliver to your address (see section 8).
6. Our Products
6.1 Images of Products on our Website are for illustrative purposes only. Fresh food naturally varies in size, colour and appearance, and packaging may vary from that shown.
6.2 Ingredient weights are approximate. Nutritional information is calculated per recipe as prepared and is approximate; actual values may vary with ingredient batches and preparation. We reserve the right to substitute an ingredient with a reasonable alternative where necessary due to availability. Where a substitution affects the allergens in a box, we will notify you before delivery where reasonably possible.
6.3 Allergens: allergen information for each month's recipes is displayed on the Website product page and on the recipe card included in each box. Our boxes are packed in a kitchen that handles allergens, and we cannot guarantee any Product is free from any allergen. It is your responsibility to check allergen information before ordering and before cooking, and to check the labels of any ingredients you add from your own kitchen.
6.4 You are responsible for inspecting the Products on delivery and storing them correctly (refrigerating chilled items promptly). Ingredients are intended to stay fresh for at least 4 days after delivery when stored correctly.
6.5 Our recipes are designed for children aged 5-10 to follow with adult supervision. An adult must supervise all cooking activity at all times, including in particular any use of knives, graters, other sharp implements, hobs and ovens. You are responsible for the safe preparation and cooking of the Products, and for judging which tasks are appropriate for your child. We accept no liability for any loss, damage or injury arising from unsupervised cooking or from the incorrect storage, preparation or cooking of the Products.
7. Cancellation, refunds and problems with your box
7.1 Perishable goods: because our Products contain fresh, perishable food, the usual 14-day right to cancel an online order and return the goods does not apply, in accordance with regulation 27(1)(c) of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. This does not affect your right to cancel your Subscription for future deliveries at any time, or your statutory rights in respect of faulty or misdescribed goods.
7.2 Cancelling before the Cut-Off: if you cancel an order or your Subscription before the Cut-Off for a delivery, you will not be charged for that delivery.
7.3 Cancelling after the Cut-Off: once the Cut-Off has passed, your box has entered preparation and dispatch. Orders cancelled after the Cut-Off will still be processed, delivered and charged, and no refund will be given. Your cancellation will take effect from the following delivery.
7.4 Damaged, missing or faulty items: if anything in your box arrives damaged, missing, or not as described, contact us at dan@gigglekitchen.co.uk within 3 days of delivery, including a photograph where possible. If we agree (acting reasonably) that an item was damaged, missing or misdescribed, we will offer you, at your choice where practicable, a replacement, an account credit, or a partial or full refund proportionate to the issue. In the event of a minor error (for example, a missing non-essential ingredient or a like-for-like substitution), we may at our reasonable discretion offer a partial refund or credit rather than a full refund.
7.5 Refunds will be made to the payment method used for the original order, within 14 days of our agreement that a refund is due.
7.6 Nothing in these terms affects your statutory rights. Advice about your legal rights is available from your local Citizens Advice or Trading Standards office.
8. Delivery
8.1 We deliver by DPD next-day service on Thursdays and Fridays. You select your delivery day when ordering. Delivery costs £4.99 per box unless otherwise stated at checkout.
8.2 We deliver to mainland UK only. We are currently unable to deliver to the Channel Islands, Isles of Scilly, Scottish Islands, Scottish Highlands, Isle of Man or Northern Ireland, or to any other postcodes identified as excluded at checkout.
8.3 DPD deliveries typically arrive between 8am and 8pm on your delivery day. You will receive tracking notifications from DPD, including a one-hour delivery window on the day. Delivery windows are indicative and not guaranteed.
8.4 It is your responsibility to provide a correct delivery address and any delivery instructions, and to keep your DPD preferences (such as a nominated safe place or neighbour) up to date via your DPD tracking notification.
8.5 If you are not available to accept delivery, the courier will follow your delivery instructions or DPD preferences. If no instructions are given, the courier may leave your box in a location they consider safe, or with a neighbour, and you will be notified. Delivery is complete, and risk in the Products passes to you, when the box is handed to you or left in accordance with this section.
8.6 Because our boxes contain perishable food, we do not re-attempt delivery. If delivery cannot be completed because the address given was incorrect, the premises were inaccessible, or no safe place or neighbour option was available, the box will be treated as delivered, and no refund will be given. The insulated packaging is designed to keep chilled items cool for up to 48 hours in transit, but we recommend bringing your box inside as soon as possible.
8.7 If your box is lost, stolen or damaged after being left in your nominated safe place or a place the courier reasonably considered safe, we do not accept liability, but may at our discretion offer a refund, credit or replacement as a gesture of goodwill.
8.8 If your box does not arrive on your delivery day, or there is any other problem with delivery, contact us at dan@gigglekitchen.co.uk and we will put it right.
9. Price and payment
9.1 Prices are as displayed on the Website at the time of your order and include VAT where applicable. Delivery charges are shown separately at checkout.
9.2 We may change our prices (including the Subscription price) at any time. Price changes will not affect any order already confirmed. For Subscriptions, we will give you reasonable advance notice by email of any change to your recurring price before it takes effect, so that you can cancel before the change applies if you wish.
9.3 Payment is taken by the payment method provided at checkout, on a recurring basis for Subscriptions. Payment details are stored and processed securely by our third-party payment providers; we do not have access to your full card details.
9.4 Failed payments: if a recurring Subscription payment fails, your Subscription will be paused immediately and no box will be dispatched. We will notify you by email so you can update your payment details and resume your Subscription if you wish.
9.5 In the event of an obvious pricing error on the Website, we are not obliged to supply Products at the incorrect price and will contact you before processing the order.
10. Promotions and offers
10.1 Introductory offer: our first-box discount (currently 30% off your first box) is limited to one per household, applies to the first box of a new Subscription only, and cannot be used in conjunction with any other offer, discount or promotion. Excludes shipping. For these purposes, a household is identified by any combination of account holder, payment card, cardholder address or delivery address that has previously used a Giggle Kitchen introductory offer.
10.2 We reserve the right to withdraw, amend or cancel any promotional offer at any time, and to cancel orders or Subscriptions where we reasonably suspect misuse of promotions, including the creation of multiple accounts to obtain promotional benefits.
11. Your content
11.1 If you share photos, videos, reviews or other content with us (for example by email, through a survey, or by tagging us on social media) and give us permission to use it, you grant us a non-exclusive, royalty-free licence to use that content in our marketing, including on our Website and social media channels, with or without attribution to your first name. You may withdraw this permission at any time by emailing dan@gigglekitchen.co.uk, and we will stop future use of your content within a reasonable period.
12. Our liability
12.1 Nothing in these terms excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) breach of your statutory rights in relation to the Products; or (d) any other liability that cannot legally be excluded or limited.
12.2 Subject to 12.1, if we fail to comply with these terms, our liability to you is limited to the purchase price of the affected Products, plus any losses you suffer that are a foreseeable result of our breach. We are not liable for losses that are not foreseeable, or for loss of income, business or profits.
12.3 We supply Products for domestic and private use only. We are not liable for any business losses.
13. Intellectual property
13.1 All intellectual property rights in our Website, recipes, recipe cards, illustrations, activity materials and branding belong to or are licensed to Giggle Kitchen Ltd. Box contents are for your personal, non-commercial use. You may not reproduce, distribute or commercially exploit our materials without our prior written consent.
14. Use of our website
14.1 The content of our Website is provided for general information and may be updated or changed at any time without notice. While we take care to keep it accurate, we do not guarantee that the Website is free from errors or omissions.
14.2 Our Website may contain links to third-party websites and services (for example, DPD tracking pages or our social media channels). These links are provided for convenience only; they do not signify our endorsement, and we are not responsible for the content, policies or availability of third-party sites.
14.3 You must not misuse our Website, including by introducing malicious code or attempting to gain unauthorised access to it, our servers, or connected systems.
15. Events outside our control
15.1 We are not liable for any failure or delay in performing our obligations caused by events outside our reasonable control, including (without limitation) extreme weather, courier network disruption, supplier failure, strikes, epidemics, or the acts of any government. If such an event affects your delivery, we will notify you as soon as reasonably possible, and where a box cannot be delivered as a result, we will offer a credit or refund for that box.
16. General
16.1 Variation: we may revise these terms from time to time to reflect changes in our business, the law, or regulatory requirements. The version in force when you place an order applies to that order. For Subscriptions, we will notify you of material changes by email; your continued use of the Subscription after such notice constitutes acceptance.
16.2 Waiver: if we do not enforce any of our rights under these terms on any occasion, that does not prevent us from doing so later.
16.3 Severability: if any part of these terms is found by a court to be invalid or unenforceable, the rest of the terms remain in full force.
16.4 Entire agreement: these terms and the documents referred to in them constitute the entire agreement between you and us in relation to their subject matter.
16.5 Transfer: you may not transfer your rights or obligations under these terms without our written consent. We may transfer ours to a successor business, provided your rights are not reduced as a result.
16.6 Communications: we will contact you by email using the address on your account. Notices to us should be sent to dan@gigglekitchen.co.uk or our registered office.
17. Law and jurisdiction
17.1 These terms, and any dispute or claim arising out of or in connection with them, are governed by the law of England and Wales. Any dispute will be subject to the non-exclusive jurisdiction of the courts of England and Wales.
